Reporting misconduct

EMHS is committed to providing the highest level of care to our community, in line with our organisational values of accountability and integrity.

If you suspect that the behaviour of an EMHS employee constitutes misconduct, there are a number of reporting mechanisms that are available to you.

What is misconduct?

Misconduct includes acts or behaviours that are unacceptable to EMHS, and may include:

  • fraud or illegal practice of a financial nature
  • breaches of patient confidentiality
  • theft by a public officer
  • physical violence, unwanted or inappropriate physical contact including excessive use of force
  • sexual impropriety – behaviour that is sexually demeaning to another individual including inappropriate comments or gestures
  • inappropriate relationships
  • incapacity or impairment to consumption of alcohol or drugs
  • medication issues, where it is alleged that the loss of patient’s medication is as a result of the actions of a public officer (for example, theft).

How to report misconduct

Under the Corruption, Crime and Misconduct Act (CCM Act) (2003) (external site), the Chief Executive of East Metropolitan Health Service (EMHS) has obligations to both the Corruption and Crime Commission (CCC) (external site) and the Public Sector Commission (PSC) (external site) in relation to reporting suspected misconduct by staff.

Complaints are different to misconduct.

A complaint is generally an expression of dissatisfaction by or on behalf of an individual consumer / carer regarding any aspect of service provided by EMHS
